Rape consists of an act of sexual penetration against the will of the victim. Rape can be charged in many circumstances, as long as the victim did not willingly consent or was unable to give consent. Some of the situations in which this may apply include those in which:

• The victim was unconscious
• The victim was mentally or physically disabled
• The victim was under the influence of an intoxicating, anesthetic or controlled substance
• Physical force, threat of force, or the threat of future retaliation was used to achieve intercourse
• A public official threatened to abuse the power they hold to the detriment of the victim
• The victim was led to believe that intercourse served professional purpose when it did not
• The victim was a minor and thus legally incapable of consenting

Per California Penal Code Section 264, rape is in most cases punishable by up to eight years in prison. Rape of a minor 14 years of age or older can result in a prison sentence of up to 11 years. If the minor is under 14 years of age, the sentence may be extended to 13 years. Aggravating factors or prior felony convictions can increase these penalties. If you are suspected of rape, contact the Law Offices of Christopher Zander & Associates immediately to start protecting your rights and to begin an aggressive defense against the charges.

Sexual assault is also known as sexual battery. It consists of touching an intimate part of another against their will or with consent which was fraudulently obtained. In order to be classed as sexual assault, it must be done for the purpose of sexual arousal, sexual gratification or sexual abuse. The social stigma attached to a sexual assault charge, even if you are found innocent, can ruin your relationships and your career. If you are suspected of sexual assault, contact the Law Offices of Christopher Zander & Associates immediately to protect your rights. The sooner you obtain legal counsel, the better your chances of achieving a positive outcome.

Our FIRM is well versed in sexual assault cases and we are tenacious in defending our clients. False allegations are often found to have occurred due to jealousy, anger, revenge, or to gain an advantage in a child custody dispute. In some cases the alleged victim did not communicate any objection to the activity, leaving the defendant with the reasonable belief that it was consensual. We will look into the details of your case to build a strong defense.

Per Penal Code 243.4, Sexual assault may be charged as a misdemeanor or felony, depending on the specifics of the incident. Both a misdemeanor or felony require registration as a sex offender if convicted. A misdemeanor conviction can result in up to 6 months in jail and a $2,000 fine (or $3,000 if the accuser is your employee). You may be placed on informal probation for up to 5 years and will have to partake in community service and treatment programs. Felony sexual assault is punishable by up to 4 years in prison, a fine of up to $10,000 and formal probation.

In addition to possible incarceration, fines, and counseling programs, you may be required to register as a sex offender for life. To complicate matters, many sex offenses very often have no witnesses other than the accuser and the accused which makes this particular type of case more complicated to defend. Under these circumstances you want an experienced and aggressive sex crime defense lawyer protecting your interests. Very often such an accusation is made for other reasons. For example, an accusation of rape after what was truly consensual sex, may be made due to “morning-after remorse”, vindictiveness, or for other reasons.

The creation of an effective defense very often requires further investigation into the facts as well as the background of the accuser. Another consideration which has to be explored, could be whether your rights were violated in any way by law enforcement personnel before or after you were charged. If so, the prosecutor or the judge may be convinced to drop the matter or dismiss the case.

California takes sex crimes very seriously and the courts will severely punish those convicted. Fines, jail time, or a record as a sex offender are all possible consequences of a conviction. Mandatory registration in a sex offender registry is also a serious result of a conviction.
