Per California Penal Code Section 264, rape is in most cases punishable by up to eight years in prison. Rape of a minor 14 years of age or older can result in a prison sentence of up to 11 years. If the minor is under 14 years of age, the sentence may be extended to 13 years. Aggravating factors or prior felony convictions can increase these penalties. Per Penal Code 243.4, Sexual assault may be charged as a misdemeanor or felony, depending on the specifics of the incident. Both a misdemeanor or felony require registration as a sex offender if convicted. A misdemeanor conviction can result in up to 6 months in jail and a $2,000 fine (or $3,000 if the accuser is your employee). You may be placed on informal probation for up to 5 years and will have to partake in community service and treatment programs. Felony sexual assault is punishable by up to 4 years in prison, a fine of up to $10,000 and formal probation.
